Terms of Service

1. Acceptance of Terms

By downloading, installing, or using PodSetup Studio ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App. These terms constitute a legally binding agreement between you and Infral Labs LLC ("we," "us," or "our").

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

2. Description of Service

PodSetup Studio is a mobile studio assistant application designed to help podcasters and content creators manage their equipment and optimize their recording setups. The App provides:

• Equipment library management and organization
• AI-powered equipment scanning and identification
• Location-based setup recommendations
• Acoustic analysis using camera and microphone
• Audio quality assessment and room analysis
• Equipment-specific configuration guidance

3. User Account and Responsibilities

You are responsible for maintaining the security of your device and all activities that occur through your use of the App. You agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer or modify the App
• Not use the App to violate any applicable laws
• Not share or distribute content generated by the App that violates third-party rights
• Provide accurate information when using the App

4. Subscription and Payments

4.1 Free Tier: The App offers a free tier with limited features, including:

• Up to 4 equipment items
• Up to 1 saved location
• 1 acoustic analysis

4.2 Premium Subscription: Premium features include unlimited equipment, locations, and acoustic analyses. Subscriptions are managed through Apple's App Store and are subject to Apple's standard subscription terms.

4.3 Billing: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You will be charged through your Apple ID account.

4.4 Cancellation: You may cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period.

4.5 Refunds: Refunds are subject to Apple's refund policy. We do not directly process refunds.

5. AI Services and Processing

5.1 The App uses artificial intelligence services (Rork AI and OpenAI) to analyze images, audio, and provide recommendations.

5.2 AI-generated recommendations are provided as guidance only and should not be considered professional advice.

5.3 You retain all rights to content you create or capture using the App. By using AI features, you grant us a limited license to process your content solely for providing the service.

5.4 We are not responsible for the accuracy, completeness, or reliability of AI-generated recommendations.

6. Data Storage and Privacy

Your equipment and location data is stored locally on your device. Photos and audio recordings are temporarily processed by our AI services and are not permanently stored on our servers. See our Privacy Policy for complete details.

7. Intellectual Property

The App, including its design, features, and functionality, is owned by Infral Labs LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

8. Disclaimers and Limitations of Liability

8.1 The App is provided "as-is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 We do not guarantee that the App will be error-free, uninterrupted, or secure.

8.3 We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to lost profits, data loss, or equipment damage.

8.4 To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Infral Labs LLC from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your access to the App at any time, with or without notice, if you violate these Terms or for any other reason at our sole discretion.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via the contact information you provided. Continued use of the App after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Connecticut.

13. Third-Party Terms (Apple)

You acknowledge and agree that: (a) This agreement is between you and Infral Labs LLC only, and not with Apple Inc. ("Apple"); (b) Apple has no obligation to provide any maintenance or support services for the App; (c) Apple is not responsible for any product warranties or claims relating to the App; (d) Apple is not responsible for addressing any claims relating to the App or your use of it; (e) Apple is a third-party beneficiary of these Terms and may enforce them against you.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
