About These Terms
These Terms of Service govern your use of the PodSetup iOS app. PodSetup is provided by Infral Labs LLC. By downloading, installing, or using PodSetup, you agree to these Terms. If you do not agree, do not use the app or service.
You must be at least 13 years old to use PodSetup. If you are under 18, you represent that you have permission from a parent or guardian.
Description Of The Service
PodSetup helps podcasters and creators manage equipment, save recording locations, generate setup guidance, scan gear, capture room photos, and analyze short audio samples for practical recording recommendations.
The app stores equipment, locations, setup notes, media files, generated guidance, and preferences locally on your device while also using limited server-side anonymous service and quota records to manage sessions, usage limits, rate limits, and subscription entitlements. Those anonymous records are based on random technical identifiers rather than your name, email, or a traditional personal account.
When you choose an AI assist after consent, PodSetup may send selected setup context, photos, audio recordings or audio-derived analysis, service profile identifiers, and request metadata to the PodSetup Railway backend. The backend may use OpenAI or another configured model provider to generate the requested result.
Informational Recording Guidance Only
PodSetup recommendations are informational only. They are not professional advice and do not replace a qualified audio engineer, electrician, attorney, venue manager, manufacturer, or safety professional when a decision matters.
PodSetup may help identify possible setup improvements, placement ideas, cable routing options, recording issues, and acoustic treatments, but it cannot guarantee better audio, compatibility with every device, safe installation, legal compliance, accurate pricing, or suitability for your specific space.
Acoustic analysis is not a calibrated room measurement system. PodSetup does not provide true RT60, absolute SPL, certified noise measurements, or professional engineering reports. Results depend on your phone microphone, phone placement, recording duration, background noise, speaker distance, room conditions, and device processing.
Your Responsibilities And Acceptable Use
You agree to use PodSetup lawfully and responsibly.
Submit, photograph, record, or upload only content you have the right to capture and process. Do not use the app to record private conversations without required consent, invade another person's privacy, upload unlawful material, or violate third-party rights.
Do not interfere with the app, misuse the service, bypass usage limits, reverse engineer service protections, attempt unauthorized access, or use PodSetup output as a substitute for professional advice or your own review of equipment manuals, venue rules, safety instructions, and applicable law.
AI Processing Authorization
To provide AI assists, PodSetup may send selected setup details, room photos, audio recordings or audio-derived analysis, PodSetup service profile identifiers, and request metadata to the backend for processing. Before your first AI assist, the app asks you to confirm that this may happen.
By using PodSetup after that disclosure, you authorize PodSetup to transmit that selected content for processing on your behalf so the app can generate practical setup guidance. If you do not want a particular setup input sent for AI processing, do not use an AI assist for that input.
The iOS app does not send your content directly to OpenAI or another model provider and does not contain private model provider API keys. The backend may use configured model providers to produce the requested response.
Subscriptions And Billing
The free tier may limit equipment items, saved locations, and acoustic analyses. PodSetup Pro provides unlimited saved equipment and locations plus 30 AI assists per UTC month, with a 10-assist UTC weekly guardrail. These AI-assist limits are hard caps, not unlimited AI access.
If you purchase a subscription through the iOS app, Apple handles billing, payment collection, renewals, cancellations, and refund processes under your App Store account terms. Subscriptions are processed through StoreKit and the Apple App Store, with RevenueCat used where available to read and sync entitlement status. We do not directly process refunds.
Pricing, included usage, trial offers, and renewal terms displayed in the app or in the App Store at the time of purchase are part of your purchase terms. You are responsible for reviewing those details before subscribing. Deleting the app or resetting local app data does not cancel a subscription.
Anonymous Service Profile, Quotas, And Rate Limits
PodSetup uses an anonymous backend service profile to authorize AI requests, sync subscription entitlement status, and enforce quotas without requiring a named app account.
Pro AI assists are limited to 10 per UTC week and 30 per UTC month. These are hard caps. The backend may also apply short-window rate limits to session bootstrap and AI requests to protect service reliability.
Quota counters, entitlement snapshots, refresh sessions, and AI-assist reservations are stored by the Railway backend. An AI assist is reserved before eligible AI generation and released if the backend request fails before completion.
Local Reset And Retained Service Records
Settings lets you reset local app data on this device. Resetting local app data or deleting the app may remove local records and media from the device, but it does not cancel subscriptions or reset server-side quota, entitlement, or rate-limit records.
PodSetup may retain limited quota, subscription, rate-limit, and service-protection records where needed to prevent abuse, enforce free and Pro AI-assist limits, preserve active Pro access, resolve entitlement or billing support issues, and support service security. Those retained records are technical records and are not intended to include your equipment names, location names, photos, audio recordings, spectrograms, setup notes, or generated setup guidance.
Privacy
PodSetup's Privacy Policy explains what the app and service collect, how AI assists are processed, how local data is stored, how privacy-focused product analytics and crash diagnostics work, and what technical records may be retained after local reset.
Third-Party Services
PodSetup uses OpenAI or another configured model provider through the Railway backend for AI assists, Apple and StoreKit for subscription purchases, RevenueCat for subscription entitlement handling, TelemetryDeck for privacy-focused product analytics, and Sentry for crash and error diagnostics.
TelemetryDeck and Sentry are not used for advertising, tracking across other companies' apps or websites, session replay, screen recording, or keystroke recording. PodSetup uses Railway for backend hosting, managed Postgres database storage, managed Redis rate-limit storage, and operational logs needed to run and protect the service.
Intellectual Property
PodSetup, including its software, design, branding, text, and related materials, is owned by Infral Labs LLC or its licensors and is protected by applicable intellectual-property laws.
Subject to these Terms, you receive a limited, non-exclusive, non-transferable, revocable right to use the app for your personal or internal creator workflow use. You retain rights to content you capture or enter. You grant us the limited rights needed to operate app features you choose to use.
Availability And Accuracy
The PodSetup backend service, purchases, network connections, Apple services, RevenueCat, Railway, OpenAI, TelemetryDeck, Sentry, and other providers may sometimes be unavailable, delayed, or produce incomplete results.
PodSetup may change, pause, limit, or discontinue parts of the app or backend service. Usage limits, included AI assists, Pro limits, and feature availability may change over time.
Disclaimer Of Warranties
PodSetup is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Infral Labs LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
PodSetup does not warrant that the service will be uninterrupted, error-free, secure, compatible with every device, or that it will correctly identify every equipment item, room issue, safety concern, cable path, acoustic problem, or recording improvement.
Limitation Of Liability
To the fullest extent permitted by law, Infral Labs LLC and its affiliates, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, device content, recordings, equipment, venue access, or creator income arising out of or related to your use of PodSetup.
To the fullest extent permitted by law, PodSetup's total liability for any claim relating to the service will not exceed the amount you paid for PodSetup in the 12 months before the claim arose.
Termination
PodSetup may suspend or terminate access to the service if you violate these Terms, misuse the app, create legal risk for PodSetup or its service providers, or if the product is changed or discontinued.
You may stop using PodSetup at any time. Subscription cancellation is handled through Apple's subscription tools.
Governing Law And Disputes
These Terms are intended to be governed by applicable United States law, without regard to conflict-of-law rules, except where applicable law requires otherwise.
Until Infral Labs LLC designates a specific state and venue in an updated version of these Terms, any dispute arising out of or relating to PodSetup that cannot be resolved informally will be brought in a court of competent jurisdiction in the United States. If mandatory consumer-protection law gives you the right to bring a claim elsewhere, this section does not limit those rights.
Changes To These Terms
PodSetup may update these Terms from time to time. If we make a material change, we will update these Terms with a revised last-updated date.
Your continued use of PodSetup after updated Terms take effect means you accept the revised Terms.
